Important remarks on new regulations on overstaying visa

Like other countries, Vietnamese government does not allow overstaying the validity of visa. This can be seen in the fine rate as well as regulations on violation of Vietnam Immigration law. Previously, all foreigners who have overstayed their visas can be directed to pay the fine fee, and complete the necessary procedure for exiting the country. At the same time, they might be eligible for having Vietnam visa approval letter, which allows them to have visa for their next entry.

It is no longer the possibility now. Since October 2018, the new regulation on banning entry for foreigners overstaying visa has been strictly implemented.

Overstaying less than 15 day

The cases of overstay no more than 15 days can be forced to follow slight punishment, in which the minimum fine fee of 1,250,000 is required. Besides, a detailed report on the reason of overstaying, and their commitment of no violation to the common security of the country must be made and submitted together with the fine fee.

For some foreigners, they may be allowed to have next entry into Vietnam. However, for other several cases, the Immigration officer may put of pending on approval for the next entry. The pending time is decided by the in-charge Immigration officer.

Overstaying more than 15 days

For weeks, no foreigners having overstaying visa in Vietnam are permitted to enter Vietnam within 3 years. Quite a few foreigners are shocked with this regulation, and many of them may suffer from damaged caused by their on-going contract with partner or their business in Vietnam.

In this case, foreigners should do as the steps below.

-       Send photo of your visa (the most recent ones)

-       Receive our consultation on the necessary document(s) and fine fee

-       Sign the paper(s) as instructed by us.

-       Submit passport and fine fee for overstaying and exit visa (if any)

The procedure may take up to one week, so make sure during this time you will have no problem with your state of having original passport beside you.

Notices on the procedure to get a visa extension

Vietnam visa extension fee is said to be too high compared with a new visa requested before you enter Vietnam. Therefore, we always recommend clients to apply for a visa with the longest validity period per their plan of staying in Vietnam. -       Visa extension requires your original passport submission and it will be kept at Vietnam Immigration Department office until the extension procedure is completed.

-       The extension fee must be prepared and paid right after you submit your passport

-       After the visa extension, you normally have to get your visa renewed or exit the country. You may apply for another visa for your entry back.

Many foreigners, especially who are in visa exemption list often choose the visa exemption right away when they plan to enter Vietnam. However, the granted period, normally 15 days or 21 days or 30 days is sometimes is too short for their plan to stay in Vietnam. Many of them may choose between extending visa or accept overstaying and pay the fine fee on the day they left the country.
