Important remarks on new regulations on overstaying visa

Like other countries, Vietnamese government does not allow overstaying the validity of visa. This can be seen in the fine rate as well as regulations on violation of Vietnam Immigration law. Previously, all foreigners who have overstayed their visas can be directed to pay the fine fee, and complete the necessary procedure for exiting the country. At the same time, they might be eligible for having Vietnam visa approval letter, which allows them to have visa for their next entry.

It is no longer the possibility now. Since October 2018, the new regulation on banning entry for foreigners overstaying visa has been strictly implemented.

The cases of overstay no more than 15 days can be forced to follow slight punishment, in which the minimum fine fee of 1,250,000 is required. Besides, a detailed report on the reason of overstaying, and their commitment of no violation to the common security of the country must be made and submitted together with the fine fee.

For some foreigners, they may be allowed to have next entry into Vietnam. However, for other several cases, the Immigration officer may put of pending on approval for the next entry. The pending time is decided by the in-charge Immigration officer.

Overstaying more than 15 days

For weeks, no foreigners having overstaying visa in Vietnam are permitted to enter Vietnam within 3 years. Quite a few foreigners are shocked with this regulation, and many of them may suffer from damaged caused by their on-going contract with partner or their business in Vietnam.

In this case, foreigners should do as the steps below.

-       Send photo of your visa (the most recent ones)

The procedure may take up to one week, so make sure during this time you will have no problem with your state of having original passport beside you.

Vietnam visa extension fee is said to be too high compared with a new visa requested before you enter Vietnam.
